The Lowry Theatre, Salford has been forced to refund the cost of a theatregoer's tickets after the venue was sued under the Trade Descriptions Act.

The audience member, named Adrian Bradbury, took action after noticing that the theatre's Christmas musical, The Wizard of Oz did not feature any live music. He was refunded £134.50 and awarded £50 legal costs.

The Lowry were quick to point out that Mr Bradbury was the only member of the audience to complain about the use of pre-recorded music. A spokesperson for the theatre added "“Whilst we respect the judge’s decision, we are disappointed with the outcome. The judge based his decision on whether he thought that Mr Bradbury’s individual expectations were met."

The Musician's Union now intends to use the case to strengthen their Honesty Code campaign which aims to ensure that all shows billing themselves as musicals actually feature live music.
