i do have booking and confirmation forms for my bookings but being honest with you all i do not have or state terms and conditions for clients in relation to bookings.

i am asking for anyone who would or could be able to either advise or could pm with their t+c's so i can get a rough idea then re-write to my own desires.

if anyone can or will help it might not be much but i would heartily give thanks to you and be very grateful for your help.

My conditions (which I have taken quite a few from various threads on this forum) are:

Booking Conditions

1. The booking of the company will only become a confirmed booking once the company has received a signed agreement from the promoter(s) before XXXX XX, 2005.

2. Cancellations must be made in writing at least 30 days prior to the date of event. If the promoter(s) fail to cancel the booking, in writing, before this date then the promoter(s) will be charged the full fee.

3. The promoter(s) will be responsible for any damage, normal wear and tear excluded, to equipment (sound/lighting equipment and/or music library) caused by anyone in attendance at the event during the contracted time period, including the time allowed for setting up and packing away, unless damage is due to the companies negligence. The full cost of any repairs required will be charged to the promoter(s) who will be advised of any damage as soon as it is possible.

4. The company does not tolerate any violent, aggressive or abusive behaviour from anyone. We reserve the right to terminate our services at any time should we feel our personal safety or the safety of our equipment is under threat. If this occurs, no refund of any fees will be given and we reserve the right to claim damages against any person(s) in addition to point 3.

5. If a booking has been confirmed and the company attends the function to find another artist or DJ has been booked by you, the promoter(s) or any other persons then the full fee shall be payable as per the agreement.

6. The company will ensure that all equipment used will carry a P.A.T Certificate as required by various venues. The company is not responsible for any damage caused to the room or building where the services are provided and is not responsible for any power outages.

7. The company agree to conduct themselves in a sober and proper manner and respond to the reasonable wishes of the promoter(s) as to volume, siting of equipment or other matters concerning peoples enjoyment of the entertainment.

8. The promoter(s) shall ensure the venue will allow the company adequate access time for the setting up and taking down of any equipment. If the performance start time is delayed due to the inability of the company to gain access to the performance area, or any other delay beyond the company’s reasonable control, no liability will be accepted and no refund will be given.

9. Payment to the company will be as stated for the agreed performance times. Any additional changes to times must be agreed in writing by both parties and subject to any possible increase or decrease of cost.

10. Public liability insurance cover is provided by the company only for the protection of the public against damage caused to the public by the company personnel or equipment and not by any action of the promoter(s) or anyone in attendance, who may cause any such damage to themselves or others which may include, but is not restricted to them being under the influence of alcohol of other substances.

11. Payments of due balances received on the date of the event must be in cash and should be delivered prior to the scheduled start time. Under no circumstances will the Company begin rendering services until the balance is paid in full.

12. The company is not responsible for obtaining any licence that may be required to stage the event. The promoter(s) shall ensure that any such licences’ are obtained at least 31 days prior to the event. If they are unable to obtain this and need to cancel the event, please refer to the point 2 above.

13. The company, at their discretion, reserves the right to discontinue all or part of equipment usage if the power provided is not capable of operating the equipment without risk of damage to the equipment, company or the public, or if the working environment constitutes a health and safety risk. The surface on which the company is to play cannot be dirt, gravel, or any other unstable surface. If applicable, the customer agrees to furnish a facility that completely covers the Company's equipment from direct sunlight and rain. If service must be discontinued for any of the aforementioned reasons, the full balance is still due.

  2. Payments

client, and paid to the company on the night of the event (unless otherwise stated).
C) If any payments are not received by the due date,a charge of £5 per day will be 
levied.
 
3. Cancellations
A) In the event of the client wishing to cancel the event for any reason the 
cancellation fee (50% of the agreed fee) must be adhered to.
B) In the event of the company wishing to cancel the event, all advance payments 
  will be repaid within five working days (unless the cancellation is the fault of the 

client not meeting the terms and conditions laid down on this form and/or contract).
 
4. Conduct
A) The client will ensure that the audience and anyone other than the company’s team 
conduct themselves in a proper manner. The company will not be held responsible for
any actions, other than actions by members of the company team.
B) The company team will conduct themselves in a proper manner throughout their 
attendance at the venue, and will respond to the clients requests (unless in breach
laws) as to volume, positioning of equipment, and any other reasonable requests.
 
  5. Security
  A) The client will be held responsible for any theft or damage of any equipment 
  (including vehicles stored on the premises) belonging to the company caused by 
  anyone other than members of the company’s team.
  B) It is solely the responsibility of the client to ensure the venue has sufficient 
  security for both personnel and equipment.
  C) The company will not be held responsible for damage to the venue caused by the 
  company’s equipment. Any potential problems must be notified to the company.
   
  6. Health & Safety
  A) It is solely the responsibility of the client to ensure the venue complies with
  all Health & Safety issues.
  B) The company will ensure their equipment fully complies with all the relevant 
  Health & Safety legislation regarding the equipment and personnel.
  C) A copy of the latest Health & Safety “Risk Assessment” can be inspected 
  (providing five working days notice is given).
  D) A copy of the latest “Portable Appliance Test” certificate can be inspected 
  (providing five working days notice is given).
   
  7. Venue
  A) The company will not be liable for breaches of byelaws, or conditions under which 
  the venue is leased, hired, or entrusted to the client.
  B) The client will ensure that all appropriate licenses (as required by law) are in 
  force at the venue at the time of the event, and therefore the company cannot be 
  held liable in any way.
  C) Both the client and the company can reserve the right to inspect all licences 
  regarding the events (providing five working days notice is given, unless otherwise 
  stated).
  D) A suitable parking area must be available for the loading and unloading of the 
  companies equipment at the venue.
   
  Please note : A PPL licence is required if you charge people for the event. 
  Therefore, for weddings or other family gatherings, this licence is not required.
   
  8. Other Things

  Due to the unsociable hours the DJ has to work the client ensure adequate 
  Refreshments are provided during the duration of the event. 



Im going to amend these soon to include the new DJ licence and the fact that I dont need one as I dont use a laptop or copies

No alterations may be made to this contract by, either the Customer or High Fidelity Mobile Disco without prior approval by, the Customer or High Fidelity Mobile Disco.

3. In the event of the Customer wishing to cancel this contract for any reason other than Act of God or National Disaster, any advance payment made will be forfeited, or a cancellation fee of not less than one half of the agreed fee may be applied for. If the cancellation is within thirty days of the performance the whole of the agreed fee may be applied for.

4. High Fidelity Mobile Disco reserves the right to substitute a similar Disco service in the event of High Fidelity Mobile Disco being unable to appear for any reason.

5. The Customer will allow suitable time for the installation and dismantling, and removal of equipment (normally one hour). Where appropriate, the Customer will arrange with the management of the Venue to allow suitable time for the installation and dismantling, and removal of equipment (normally one hour).

6. High Fidelity Mobile Disco accept music lists and requests in advance of functions & will endeavour to play up to 20 of the clients chosen requests, provided such requests are submitted in writing, at least 1 week before the event. The client also agrees that High Fidelity Mobile Disco cannot guarantee the inclusion of any difficult to source, obsolete or deleted titles either requested at the event or previously notified. If you are unsure about any request then please contact us. For legal copyright reasons, we will only play client provided track/s if they are supplied on an original audio CD.

7. High Fidelity Mobile Disco will not play songs with explicit or offensive language, or any track that the DJ considers would cause offence to any guests attending the function. If you are unsure about any track then please contact us.

8. Where the function is to be held on the Customers property, the Customer will also ensure that safe and adequate power is available. (Normally a minimum of 2x13Amp sockets with a combined minimum continuous load capacity of 4.5Kilowatts (20 Amps) for a full sound and lighting set-up, or for a reduced set-up, 1x13Amp socket with a minimum continuous load capacity of 3Kilowatts (13Amps)).

9. High Fidelity Mobile Disco ensures that any equipment to be connected to a power source is electrically safe, has passed PAT electrical safety testing,  and conforms to the HSE EAW Act 1989, and any amendments thereafter.

10. High Fidelity Mobile Disco and any assistants will conduct themselves in a proper manner throughout their attendance at the venue, and will respond to the Customers/ Venue Managements requests as to volume, siting of equipment and, or any other reasonable requests.

11. High Fidelity Mobile Disco shall be in no way liable for breach of byelaws, or conditions under which the venue is leased, hired or entrusted to the Customer. The Customer/Venue Management also ensures that all appropriate licenses, as required by law, are in force at the time of the performance(s).

12. The Customer/Venue Management will provide adequate supervision of it’s guests, customers and, or staff at the venue, and will be liable for any loss of, or damage to, the equipment, vehicles, or personnel belongings, caused by guests, customers and, or staff.


Most of these were adapted from others on the forum.

Following on from the recent topic about music supplied by the customer on CDR, I am now considering changing the last part of number 6.

These are our Terms & Conditions and may be of help to you.


The contractual terms between Stephen Skinner, t/a Double “S” Music Machine , ( hereafter referred to as “the discotheque” ) and those purchasing services from the discotheque are contained exclusively within these terms and conditions. These conditions and the contract shall be subject to and construed in accordance with the Law of England.

In no circumstances will the discotheque be bound by any addition to or other variation of these terms, whether oral or in writing, unless any such addition or variation is agreed in writing by the discotheque with express reference to these terms

This contract is agreed between ( hirer's name ) hereafter referred to as “the hirer” and the discotheque.

1. The date, type, times and place of engagement and fees are as specified on the front of this document.

2. The hirer shall at all times, have complete supervision, direction and control over the services provided by this agreement and the ends to be accomplished as long as they are in keeping with accepted professional practices and equipment capabilities.

3. The liability of the discotheque to perform said services is subject to proven detention by sickness, accidents or any other actions not under its control.

4. This agreement may be cancelled by either party only on written notice at least 30 days prior to the engagement(s) noted above. The burden of proof of cancellation will be on the cancelling party. Cancellation by the discotheque will result in full refund of all payments. Timely cancellation by the hirer will result in the refund of all payments received by the discotheque less the deposit. Should the hirer cancel less than 30 days prior to the engagement(s) noted above the full fee will be payable.

5. All payments made towards the obligations stated in this agreement, except as indicated in paragraph 4, will be non-refundable

6. Payment of the final balance due must be made by cash, cheque or bank transfer no later than 10 working days prior to the date of the engagement and appearance by the discotheque on the date, for the times and at the place of engagement specified on the front of this document is contingent upon this. In no circumstances, other than specified in clause 8, will post dated cheques or “cash on the night” be acceptable.

7. The liability of the discotheque shall not exceed the amount of payments received by the discotheque.

8. If, during the engagement, the hirer requests extra playing time beyond that specified overleaf, the discotheque will comply, if possible, at the rate of £60 per hour or part thereof up to and including midnight and £80 per hour or part thereof from midnight onwards, payable in cash in advance. However this will be dependent upon the agreement of the venue management and all other concerned parties. Notwithstanding this, prior arrangements or commitments may prevent agreement to play for extra time. Consequently the right not to go beyond the time specified overleaf is reserved.

9. All venues are visited in advance to ensure adequate power supplies are available, to determine the most advantageous positioning for the discotheque equipment and to arrange access etc. with the venue management. Notwithstanding this it is ultimately the hirer’s responsibility to ensure that enough power and space are available and the discotheque cannot be held responsible for any lack of power supply, insufficient space within which to set up or other facilities not under its control, which will be detrimental to carrying out the engagement. Power must be available within the area in which the discotheque will be set up. In permanent venues this means at least 3 and preferably 4 x 13 amp sockets must be available adjacent to the operating area. In marquees at least 3 and preferably 4 x 13 amp sockets must be available no more than 1 metre away from the operating area having been run by the hirer or the hirer’s agent to the discotheque area from the power source. If there is necessity to run cables from a generator distribution board or any other source to provide the correct power configuration it is the hirer’s responsibility to ensure this is done. If it is not done and cabling has to be supplied and installed by the discotheque then a supplementary charge of £25 per half hour will be applied for time spent and equipment supplied. However this neither implies nor guarantees that the discotheque will be able or liable to provide such service.

10. The hirer agrees to assume complete liability for all claims of personal injury or property damage arising from the engagement(s) noted herein and hold the discotheque harmless in all such cases, except when caused by an employee/agent of the discotheque.

11. The discotheque will not be held responsible for injury to the hirer’s guests or the hirer’s guests’ children who interfere with the discotheque equipment in any way.

12. Where it is under the hirer’s control, the hirer agrees to maintain adequate security in the service and access areas so as to protect the property of the discotheque from theft, vandalism or other damage. The hirer also agrees to be fully responsible for loss or damage (including weather damage) to equipment used to provide the services noted herein while said equipment is situated on property owned by or under the control of the hirer, except damage caused by an employee/agent of the discotheque.

1.    Where required, a 25% deposit must be paid no later than 14 days after receiving the confirmation letter. After this, £5 per day will be added to the bill. The deposit is non-refundable.

2.    Financial settlement of the remaining balance to take place at the end of the performance by cash, or cheque made payable to Oliver Head. If payment is not received after the performance, OTronics Media Services will charge £5 extra per day past the due date.

3.    In the extremely unlikely event of OTronics Media Services failing to attend the performance, the hirer will not be expected to pay any remaining balance and in this instance only will any deposit be refunded.

4.    Should OTronics Media Services be temporarily rejected at arrival of the venue due to late arrivals of guests etc, the full remaining fee is expected to be paid at the end of the performance.

5.    Should additional performance time be required, add £20 per extra hour performed.

6.    The Booking Form is proof of verbal or electronic agreement and shall include any other terms and conditions agreed before issuing. Any alterations must be made by the Organisers or OTronics Media Services and must be agreed by both parties.

7.    If the event has to be cancelled for any reason, a cancellation fee will NOT be charged, however any deposit received will not be returned (see clause 1). In the event of cancellations, OTronics Media Services must be notified immediately.

8.    Should there be a power failure upon arrival of OTronics Media Services at the venue, 50% of the remaining fee is to be paid. Should a power failure occur at any point after the performance has started, the full remaining fee is to be paid. Should equipment failure of OTronics Media Services occur at any time during the event, no fee is payable, however backup equipment is always carried.

9.    The event may be rescheduled to an alternative date if necessary for no extra fee should unforeseen circumstances arise, provided OTronics Media Services are available.

10.  The Organisers will allow suitable time for setting-up (normally one and a half hours maximum) and dismantling and removal of equipment (forty minutes maximum). The Organisers will also ensure safe and adequate power is available (at least two 13amp sockets). OTronics Media Services will ensure equipment is electrically safe and Portable Appliance Tested (PAT) and is installed appropriately.

11.  OTronics Media Services will conduct themselves in a proper and efficient manner throughout the event and will respond to any of the Organisers reasonable requests such as volume levels.

12.  The Organisers will ensure suitable supervision of it’s guests and assistants at the venue. OTronics Media Services will not be held responsible for any unforeseen damage to the Organisers facilities caused by disco equipment, however any accident that could have been avoided will be financed OTronics Media Services to recover any loss.

PLEASE READ THE FOLLOWING:

We have police checks for undertaking children’s disco’s, carry Public Liability Insurance (PLI) of up to
£1.3 million and have Portable Appliance Testing (PAT). Proof of these documents can be provided on request.

We use a Strobe light and Fog machine.

Strobe lights can affect people with epilepsy. A warning sign will be displayed at the venue and the light will be used in short bursts at an average of ten flashes per second. However, if you wish for the effect NOT to be used, please tick this box:

Fog machines can affect people with asthma and such illnesses. If you wish for the machine NOT to be used, please tick this box:

Terms and Conditions

1. A booking of the company will not be confirmed until a deposit of 25% of the agreed amount has been paid and written confirmation has been received by the client off the company, signed by the client and returned to the company for the said booking.
2. The remainder of the booking fee shall be deemed payable by the client in cash to the company on arrival at the venue and prior to the commencement of performance.
3. Cancellations of any said booking for any reason other than an ACT OF GOD, NATIONAL DISASTER or WAR must be made in writing from the client to the company 30 days prior to the date of the booking.
4. Any cancellation in writing received from the client to the company 30 days or under prior to the date of the booking then the client will be liable for the agreed full amount.
5. The company reserve the right to provide a substitute disco service in the event of the company being unable to appear for any reason.
6. The client shall be deemed liable for any damage to company vehicles parked at or on the venues property, excluding normal fair wear and tear to equipment including sound/lighting equipment including stands and/or music library, caused by anyone in attendance of the booking during the said times agreed and including setting up and dismantling of equipment. Unless damage is caused by the company. And for security to company personnel.
7. In the case of any damage caused by anyone in attendance of the booking the full cost of repairs and/or hire charges for replacement or loan equipment will be charged to the client at the rate of charge incurred by the company.
8. The client will allow suitable time for the company to set-up and dismantle equipment and will arrange with the management of the venue to allow this time to set-up and dismantle equipment prior to commencement of the booking.
9. If a booking has been confirmed in writing between the client and company and upon arrival at the venue the company find another dj/service has been booked by the client or someone acting on behalf of the client then the full amount shall be payable to the company.
10. The company will ensure that all equipment used will be P.A.T tested to conform to HSE EAW act 1989 and said equipment will carry safety stickers and certificate of testing is carried by the company for producing. The company will not be held responsible for any damage caused to the electrical point, room and/or building where the services are provided and is not responsible or liable for any power outages.
11. The company will ensure that public liability insurance is provided but only for the protection of the public against harm, pain or suffering caused to the public by company personnel or equipment and not by any actions of the client or guests who may cause or instigate such harm, pain or suffering to themselves or others under the influence of alcohol or other substances.
12. The company will accept music requests in writing in advance 14 days prior to the booking and will do our utmost to play at least 15 of the clients chosen requests if received . The client also agrees that the company cannot guarantee the inclusion of any deleted, obsolete or difficult to source requests either in writing or on the night of the booking.
13. The company will endeavour not to play songs with explicit or offensive lyrics that would cause offence to any guests attending the booking. If unsure about any songs please do not hesitate to contact us.
14. Under no circumstances whatsoever will the company tolerate any abusive, aggressive or violent behaviour from ANYONE whatsoever at the booking towards the company and/or personnel of the company and reserve the right to terminate our services at any time should we feel our personal safety or the safety of the equipment is under threat of harm, pain or suffering. If this occurs no refund of any amount will be given and the company reserve the right to claim damages against any said persons in addition to point 3.
15. The company shall not be liable for breaches of byelaws and/or conditions under which the venue is entrusted, hired or leased to the client. The client will ensure all appropriate licences(as required by law) are in force at the venue at the time of the event, therefore the company cannot be held liable in anyway.

A few things you might want to consider.

Doesn't seem to read right to me. You could certainly lose the "of the company" from the first line, and maybe change the working to read something like "a deposit of 25% together with a signed cintract"

What if I've booked you for six months in advance and want to pay you the balance 1 month before the event?

3. Cancellations of any said booking for any reason other than an ACT OF GOD, NATIONAL DISASTER or WAR must be made in writing from the client to the company 30 days prior to the date of the booking.
4. Any cancellation in writing received from the client to the company 30 days or under prior to the date of the booking then the client will be liable for the agreed full amount.


Reading the 2 of these, if I cancel 30 days before then I'm allright - Oops, according to 4 I'm liable for the agreed full amount. I would also consider changing "will be liable" to may be liable". If I got a booking to replace a cancellation then I wouldn't bother trying to get the fee from the one that cancelled.

I think you could merge 6 & 7 together.

There are a couple of other things that I would not have put in, or worded quite the same way, but that's just my opinion and you have to go with what you feel is right for you.
